The following Terms of Service govern all use of the highresolution.photography website and all content, services and products available at or through the website (taken together, the Website). The Website is owned and operated by highresolution.photography. The Website is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies and procedures that may be published from time to time on this Site by highresolution.photography (collectively, the “Agreement”).
Please read this Agreement carefully before accessing or using the web site. By accessing or using any part of the Website, you agree to become bound by the terms and conditions of this Agreement. If you do not agree to all the terms and conditions of this Agreement, then you may not access the Website or use any services.
Who can use High Resolution Photography
You may use the Website only if You can form a binding contract with High Resolution Photography, and only in compliance with these Terms and all applicable laws. Any use or access by anyone under the age of 13 is prohibited.
Downloading and use of Images
CC2 Via download provided Images on High Resolution Photography are bound to Creative Commons Deed CC BY-ND 2.0. To the extent possible under law, uploaders of High Resolution Photography have waived some copyrights and related or neighboring rights to these Images. You are free to Share — copy and redistribute the material in any medium or format for any purpose, even commercially. The licensor cannot revoke these freedoms as long as you follow the license terms.
Limitations
Images depicting identifiable persons may not be used for pornographic, unlawful or other immoral purposes, or in a way that can give a bad name to people, or to imply endorsement of products and services by those persons, brands, organisations, etc. Since High Resolution Photography does not require a written Model Release for each Image that has identifiable people on it, We cannot guarantee that You will be able to use the Image for any purpose You like. Also, if there is a model release for the Image, We do not represent or make warranties whatsoever as to the legality or validity of it.
Furthermore, High Resolution Photography does not represent or make any warranties that it owns or licenses any of the mentioned, nor does it grant them. It’s your and the Image uploader’s responsibility to make sure that all the necessary rights, consents and licenses for the use of the Images are provided.
You are not allowed to mass download Images with an application, or reuse a big part of the Images for redistribution on a similar Website. Texts including image descriptions and tags are copyrighted.
High Resolution Photography cannot be held responsible for any copyright violations, and cannot guarantee the legality of the Images stored in its system. If You want to make sure, always contact the photographers. You use the site and the photos at your own risk!
Uploading Images
You may upload photographs or graphics images to the Website, and High Resolution Photography will screen these uploads to see if they are suitable for distribution. We may or may not publish your upload/uploads if we decide does not meet our photo gallery aesthetics requirment.
By uploading, You release Images under Creative Commons Attribution-NoDerivs 2.0 Generic. This applies worldwide. In case this is not legally possible, You grant anyone the right to use this work for any purpose, without any conditions but the ones stated by the license, unless such conditions are required by law.
You are solely responsible for the Images You upload. You warrant that You own all proprietary rights regarding the Image, and You are obliged to obtain a non-exclusive, perpetual, irrevocable, worldwide, and royalty-free Model and/or Property Release and/or any other permission necessary concerning the use of this work for any purpose, without any conditions, unless such conditions are required by law.
Furthermore, You acknowledge that High Resolution Photography does not allow the upload of Images that infringe on any copyright, property right, trademark or any other applicable right.
You accept that even though We do our best to prevent it from happening, High Resolution Photography cannot be held responsible for the misuse or abuse of any Image.
We also reserve the right to remove any approved Image at any time if We believe it’s defective, of poor quality or infringe on any right.
Responsibility of Website Visitors: highresolution.photography has not reviewed, and cannot review, all of the material, including computer software, posted to the Website, and cannot therefore be responsible for that material’s content, use or effects. By operating the Website, highresolution.photography does not represent or imply that it endorses any posted material, or that it believes such material to be accurate, useful or non-harmful. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. Disclaimer of Warranties: The Website is provided “as is”. highresolution.photography and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither highresolution.photography nor its suppliers and licensors, makes any warranty that the Website will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, the Website at your own discretion and risk.
Limitation of Liability: In no event will highresolution.photography, or its suppliers or licensors, be liable with respect to any subject matter of this Agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental, indirect or consequential damages; (ii) the cost of procurement or substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for direct damages in an amount in excess of $250 USD. highresolution.photography shall have no liability for any failure or delay due to matters beyond its reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.
General Representation and Warranty: You represent and warrant that (i) your use of the Website will be in strict accordance with the highresolution.photography Privacy Policy, with this Agreement and with all applicable laws and regulations (including without limitation any local laws or regulations in your country, state, city, or other governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside) and (ii) your use of the Website will not infringe or misappropriate the intellectual property rights of any third party.
Indemnification: You agree to indemnify and hold harmless highresolution.photography, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all losses, damages, claims and expenses, including attorneys’ fees, arising out of your use of the Website, including but not limited to any such losses, damages, claims and expenses arising out of your violation of this Agreement.
Miscellaneous: This Agreement constitutes the entire agreement between highresolution.photography and you concerning the subject matter hereof, and they may only be modified by a written amendment signed by an authorized executive of highresolution.photography, or by the posting by highresolution.photography of a revised version which you affirmatively accept by clicking “I accept,” “I agree” or similar act of assent.
